These Terms of Service (“Terms”) govern your use of the Flux platform (“Service”) operated by Socium IT (“we,” “us,” or “our”). By accessing or using Flux at fluxiod.com and app.fluxiod.com, you agree to be bound by these Terms.

Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Service Description

Flux is a software-as-a-service (SaaS) portal designed for managing Lumen Internet on Demand (IoD) connections. The Service allows you to schedule bandwidth, monitor usage, and control costs across your Lumen IoD connections through integration with the Lumen API. Flux is not affiliated with or endorsed by Lumen Technologies.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date. You agree to notify us immediately of any unauthorized use of your account.

Payment Terms

Flux is billed on a monthly subscription basis:

  • Base fee: $50 per month for platform access.
  • Per-connection fee: $15 per month for each Lumen IoD connection managed through the Service.

Payments are due at the beginning of each billing cycle. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days’ written notice. Failure to pay may result in suspension or termination of your account.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to transmit malicious code or engage in any activity that could harm our infrastructure.
  • Resell or redistribute access to the Service without our written consent.

Intellectual Property

The Service, including its design, features, and content, is owned by Socium IT and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your subscription.

Limitation of Liability

To the maximum extent permitted by law, Socium IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

Termination

You may cancel your subscription at any time through your account settings or by contacting support. We may suspend or terminate your account if you violate these Terms or fail to pay applicable fees. Upon termination, your right to use the Service ceases immediately. We may retain your data for up to 90 days after termination before deletion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last Updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
